Marion County Felony Case Process
Felony cases in Marion County follow Indiana's standard felony process. After arrest, the Indianapolis Metropolitan Police Department or the Marion County Sheriff books the individual at the jail. The Prosecutor's Office then has 72 hours to file charges or release the person. If charges are filed, the case proceeds to an initial hearing in Marion County Superior Court.
Each step from the initial filing through sentencing produces records that become part of the Marion County felony file kept by the clerk. These records are public. Case dockets, charging documents, plea records, and final judgments are all accessible. For cases that result in prison sentences, the Indiana Department of Correction tracks the offender. You can look up current IDOC inmates statewide at offenderlocator.idoc.in.gov. For custody change alerts for anyone held at the Marion County jail or an IDOC facility, sign up for Indiana SAVIN, which provides free notifications.
Marion County also has a dedicated Indiana Judicial Branch county page at in.gov/courts/local/marion-county. This page lists the court divisions, judges, and contact information for each criminal court in Indianapolis.
Indiana State Police Criminal History for Marion County
The Indiana State Police Limited Criminal History system at in.gov/ai/appfiles/isp-lch runs a name-based search across all Indiana counties, including Marion County. The fee is $15.70 per search, paid by credit card online. This search covers felony arrests and Class A misdemeanor arrests going back decades and pulls data from Indiana law enforcement statewide, not just Marion County.
The ISP LCH result is not a court-certified document. For official certified copies of Marion County felony records, contact the Marion County Clerk at the Records Facility on Madison Avenue. The ISP search is faster and covers more counties; the clerk's office provides the official case file documents.
Note: The ISP Limited Criminal History search returns records only for fingerprint-backed entries in the state system, so some older Marion County records may not appear.
Expunging Marion County Felony Records
Indiana's expungement law at IC 35-38-9 allows Marion County residents to petition the Superior Court to seal certain felony records. Filing fees for expungement petitions are waived under Indiana law. Once the court grants the petition, the sealed records are removed from MyCase and the ISP criminal history system. The Marion County Clerk processes the expungement order and updates the case file accordingly.
Waiting periods vary by offense type. Arrests without a conviction may qualify after one year. Less serious felony convictions require an eight-year wait from the date of conviction or release. More serious felony convictions require ten years and written consent from the Marion County Prosecutor before a court will consider the petition. All fines, fees, and court costs must be paid before filing. Some offenses, including murder, most sex crimes, and serious violent felonies, cannot be expunged under IC 35-38-9-8.5.
For guidance on whether your Marion County felony record qualifies, contact the Indiana Public Access Counselor at in.gov/pac. Legal aid organizations in Indianapolis may also help low-income residents file expungement petitions at no cost.
